1. Scope
These terms apply to contracts with Majerowicz.com for IT services, consulting, setup, migration, workspace, backup, remote access and support. Individual quotations, service descriptions and data-processing agreements prevail in case of conflict. Mandatory consumer rights remain unaffected.
2. Contract formation
A contract is formed by acceptance of a quotation, an express order confirmation, a completed checkout or activation of the agreed service.
3. Service scope
The binding scope, user or device numbers, storage, support, term, fees and any service levels follow from the quotation, package, service description and confirmation.
4. Customer duties
The customer provides accurate information, protects credentials, maintains systems and internet access, respects third-party rights and reports security incidents without delay.
5. Fees, term and cancellation
The agreed prices, billing periods, minimum terms and notice periods apply.
6. Availability and maintenance
Continuous availability is owed only where expressly agreed as an SLA. Maintenance, updates and infrastructure or internet outages may temporarily affect use.
7. Backup responsibility
The specific protection and recovery scope is defined in the applicable service description. Unless otherwise agreed, the customer remains responsible for data selection, statutory retention and appropriate recovery tests.
8. Liability
Statutory liability rules apply. Limitations do not apply to intent, gross negligence, injury to life, body or health, or other mandatory liability.
9. Governing law and jurisdiction
German law applies to the extent permitted. For merchants, legal entities under public law and special funds under public law, Pasewalk is the place of jurisdiction. Depending on the statutory subject-matter jurisdiction, Amtsgericht Pasewalk or Landgericht Neubrandenburg is competent. Mandatory jurisdictions, particularly consumer rights, remain unaffected.
